In order to enhance the regulations to gaming credits in casinos, the Macau Legislative Council has promulgated the “Legal Regime of Casino Gaming or Gambling Credit" in 2004. Despite regulating gaming credits in casinos, this law also aims to clarify the characteristic of gaming debts arising from casino gaming credits, in order to prevent difficulties in recovering such gaming debts, namely in cross-border execution. However, the implementation of the above mentioned law in cross-border execution has not been too satisfactory so far. This essay, therefore, this topic cross-border execution of legal obligation arising from casino gaming credit has been chosen in order to make further studies on this issue. The essay has been separated into four chapters: The first chapter is the classification and distinction of casino gaming credits, in which can be divided into two different sections, the first section focuses on the discussion about debts arising from casino gaming credits, analyzing and distinguishing the different characteristics of such gaming debts. The second section is the discussion on debts arising from loans for consumption for gaming purpose, as to define the concepts between gaming loan and gaming credit, by also pointing out their differences in a legal perspective. The second chapter is the study of paying off the gaming credit through judicial procedures in different jurisdictions (including analysis to the legal regimes of China, Macau and Taiwan). This can be separated into three sections, the first section is about to determine the ways available in repaying gaming credit. The second and the third sections are about to analyze the common procedures and execution procedures in China, Macau and Taiwan, and to point out their actual status in dealing with gaming credit, in order to analyze the feasibility of recovering debts through courts in the above three jurisdictions. The third chapter is the discussion among the feasibility of cross-border execution of gaming credit (by the view of the foreign sentences recognition system). This has been separated into three sections, firstly introducing the foreign sentences system and its conditions in China,Macau and Taiwan, then pointing out the similarities and differences among such systems. The forth chapter is about the dilemmas and challenges faced in cross-border execution of casino gaming credit. This has been separated into three sections, the first section is the reasons why the difficulties in cross-border execution exist. The second section is a discussion on the current circumstances of sentence recognition in civil and commercial matters, under the framework of judicial cooperation among China, Macau and Taiwan, then referring to the controversial issue on public order among these three jurisdictions. The third section is the Author's personal opinion regarding to public disorder on gaming credit. At last, as conclusion, giving out suggestions about the feasibility of cross-border execution between China, Macau and Taiwan. Key words: Macau Gaming Credit, Cross-Border Execution, Public Order

為了更好規範娛樂場博彩信貸的情况，澳門立法會於 2004 年頒布了《娛樂場博彩或投注信貸法律制度》,这個法律除了規範澳門娛樂場的信貸活動外，還希望藉此明確博彩信貸關係而產生的债務性質，以避免在收回博彩或投注信貸業務所生的债務方面出現困難，尤其在跨境進行追討和執行的情况。然而，上述的法律頒布至今，上述跨境執行的情况仍然不樂觀，故本文選題《娱樂場博彩信貸產生的合法债務跨境執行之研究》，希望一探究竟。 本文共分為四章: 第一章為娛樂場博彩信貸產生的債務性質之識別及區分，可分為二小節，第一小節為因娛樂場博彩而產生之債務;首先對直接因博彩活動產生的債務之性質作出分析和區分。第二小節為供博彩為目的而作出之消费借貸及其性質;以界定了博彩借貸與博彩信貸的概念，繼而區分兩者在法律上的差異，從而確定本文的研究對象。 第二章為博彩信貸透過各地司法途徑清償之研究—從三地的司法程序出發；是以中國、澳門、臺灣三地法律制度進行分析。可分為三小節，第一小節為確定博彩信貨可獲得清償的途徑;第二小節與第三小節則是透過對中國、澳門、臺灣三地的執行程序與普通程序作出分析，並指出三地目前对涉及博彩信貸案件的實際現况，繼而分析向三地法院追討博彩信貸債務的可行性。 第三章為娛樂場博彩信貸跨境執行可行性的探討——從三地的承認外地裁判制度出發;可分為三小節，先簡述中國、澳門、臺灣三地在法律上對外地法院之裁判的制度及要件，並指出相關制度的相同和不同之處。 第四章為娱樂場博彩信貸跨境執行困局與挑戰，可分為三小節，第一小節為指出博彩信貸跨境執行困難的原因;第二小節為中國、澳門、臺灣三地目前在司法協助下對民商事裁判的承認的情况，並對三地最有爭議的公共秩序作出探討，第三小節為筆者對博彩信貨是否違反公共秩序的看法，最後提出在中國、澳門臺灣三地跨境執行的可行性。 關鍵字:澳門博彩信貸，跨境執行，公共秩序
