This dissertation introduces by means of a comparative study of the meanings of administrative decision for local and for eign law professions, the principle of decision-making as a basic principle of the Macao Administrative Law.And discusses the evolution, the theoretical basis, and legal values of the principle of decision-making.The principle of decision-making of the legal values are reflected in:(1) the control over executive power and the promotion of administration according to law;(2) justice, efficiency, and the reduction of conflict;(3) respect for the rights of the administration counterparts, and the promotion of cooperation;(4) establishment of the law enforcement authority and responsibilities of the administrative subject and administrative responsibility.At the same time,details the principles of decision -making and its scope with case studies and explores the different systems under the principles of decision-making and tacit respectively.These include express decision, tacit decision, tacit approval and tacit rejection and also points out the disadvantages of not making a n express decision.At the end, analyses and studies the legal effects of the Principles of Decision -Making.

本 文 在 綜 合 比 較 國 內 外 行 政 法 學 界 關 於 行 政 決 定 含 義 的 基 礎 上，對 作 出 決 定 原 則 作 為 澳 門 行 政 法 基 本 原 則 進 行 了 闡 述；研 究 了 對 作 出 決 定 原 則 的 演 進、理 論 依 據 及 其 法 律 價 值，提 出 該 原 則 的 法 律 價 值 體 現 在 ： 一、控 制 行 政 權 力，促 進 依 法 行 政；二、公 正、效 率 的 體 現，減 少 摩 擦 ； 三、尊 重 相 對 人 的 權 益，促 進 合 作；四、樹 立 行 政 主 體 執 法 的 權 威 及 責 任 行 政。同 時，本 文 結 合 有 關 案 例，對 作 出 決 定 原 則 的 主 要 內 容 及 適 用 範 圍 進 行 闡 述；分 別 對 明 示 決 定、默 示 決 定、默 示 批 准 和 默 示 駁 回 制 度 進 行 闡 釋，並 指 出 不 作 出 明 示 決 定 的 幣 端。最 後，對 作 出 決 定 原 則 的 法 律 效 果 進 行 分 析 研 究 。 關 鍵 字 ： 作 出 決 定 原 則 ， 行 政 程 序 法 基 本 原 則 ， 責 任 行 政
