Since the official promulgation and implementation of The Government Information Disclosure Regulation of the People’s Republic of China , our government has got rapid and comprehensive development in terms of information disclosure. The development of the technology and particularly the creation and the population of the new media communicated by network bring both challenge and changes for the government information disclosure. Comparing our present laws and rules of government informat ion disclosure with those developed countries, there are many problems in the system, like single means in information disclosure, low-rated operability and imperfect related legal system and so on and these problems are not suit for the progress of our democracy and legal construction. By researching how other countries and regions obtain public information, mainly in the background of information disclosure and in the construction in American, EU, Japan, also Hong Kong, Macau and Taiwan of China, this paper is to discuss the shortage and weakness as well as the difficulties facing in the progress of our government information disclosure and the current status of our government information disclosure and puts forward the strategy and vision for the development and improvement of our government information disclosure.

《中 華 人民 共 和國 政府 信 息公 開 條例 》頒 佈 與施 行 以來 ，我國的政 府 在信 息 公開 方 面得 到了 快 速、 全 面的 發展 。 但是 ， 隨著 科技 的 發展 尤 其是 以網 絡 為媒 介 的新 型傳 播 媒體 的 產生 與普 及 ，不 斷 為我 國的 政 府信 息 公開 工作 帶 來新 的 挑戰 。目前 ，我 國 現有 的 政 府信 息 公開 法 律制 度與 國 外相 比， 仍存 在 不少 問 題。例如 ，信 息公 開 手 段單 一 ，救濟 保 障 機制 可 操作 性 不高 ， 相關 配 套法 律 體繫 不 夠 完 善等 等 ，與 我國 民 主與 法 治建 設的 發 展進 程 不相 適應 。 本 文 通過對 域 外 國 家 及 地 區 政 府 信 息 資 源 公 共 獲 取 先 進 制 度 進 行 研 究， 其 中主 要 是對 美國 、 歐盟 、 日本 以及 我 國港 、 澳、 臺地 區 有關 信 息公 開立 法 背景 以 及相 關法 律 制度 進 行比 較研 究 分析 ， 探討 我國 政 府信 息 公開 制度 所 存在 的 缺陷 與不 足 ，以 及 所面 臨的 困 境 ， 進 而提 出發 展 與完 善 我國 政府 信 息公 開 制度 的 構想和策 略 。
