The present thesis focuses on the constitutional culture of Hong Kong after its transition. It consists of three main chapters. The first chapter, based on sociological methodology, analyzes the nature and character of the Modernity, historically points out that, the Modernity as the grand narrative has had a remarkable influence on the social development of Hong Kong, China and the world in general. In the context of postcolonial theory, this chapter will examine the social attitudes and the state of legal culture of Hong Kong after its transition. Furthermore, it will also discuss the nature of the identity dilemma of Hong Kong people. The second chapter turns to the micro level to observe the constitutional culture of Hong Kong after its transition. It contains three sections. Section one appraises the issue of ultimate authority in the constitutional order of Hong Kong. Section two looks at the political system and the constitutional positioning. Section three considers the democratic politics of Hong Kong. The third chapter comes back to the macro level. Section one is about deliberative democracy, this section starts by comprehensively evaluating the limitations of the Modernity and its important element----liberal democracy, and then explores the benefits of deliberative democracy, Section two looks at the culture trend over the world under the impact of globalization, it further considers an alternative concept of Modern Consciousness which argues that different cultures have to develop concurrently and equally through the constructive dialogue. Finally, the chapter proposes the author's view of the future constitutional development of Hong Kong.

本文旨在探析中国对香港恢复行使主权后的香港宪政文化。论文主体部分共分为三章。 第一章运用社会学研究方法，通过分析“现代性”的本质和特征，指出“现代性”作为“宏大叙事”对世界历史以及中国和香港的社会发展所产生的深远效应。借用后殖民理论剖析脱殖后的香港社会心态和法文化状况，探讨香港身份认同困境的实质。 第二章进而从微观角度关注香港宪政文化，考查并评析中国对香港恢复行使主权后的香港宪政秩序中的最终权威、政治体制与宪政定位以及民主政治等问题。第三章重新将视点引入宏观层面，重在综合反思“现代性”及其重要价值——自由主义民主的局限性，提出审议式民主之借鉴和启示，揭示全球化冲击下的世界文化走向，引出“现代意识”之概念，强调多元文化的平等发展和建设性对话，为未来香港宪政发展道路确立坐标。
